On November 25, 2015, at the 10th session of the XIII National Assembly passed the Law on fees and charges No. 97/2015 / QH13, accordingly, Article 24 of the Law stipulates a list of products and services transferred from pricing fees set by the State; The Government stipulates the agency competent to decide on prices and forms of pricing. Therefore, it is necessary to amend and supplement the necessary contents above in Decree No. 177/2013 / ND-CP of November 14, 2013 (ND 177) detailing and guiding the implementation of a number of articles of the Law Prices with regulations on authority and pricing for products and services transferred from fee to price when the Law on Fees and Charges takes effect from January 1, 2017, as well as regulations on price management in the form of price declaration for a number of products and services changing from fee to price that the State has not set prices but it is necessary to have an appropriate mechanism to regulate and regulate prices to ensure that institutionalizing the socialist-oriented market economy development policies and policies of our Party and State, promoting socialization of public services through mechanisms price management roadmap accordingly.

Problems that need to be addressed

Article 24 of the Law on Fees and Charges No. 97/2015 / QH13 stipulates that 17 fees will be transferred according to the price mechanism set by the State. This imposes new requirements and duties on price management, such as the need for specific provisions on authority and pricing for these products and services, while provisions on authority. State valuation and the valuation form were stipulated in Decree 177 issued earlier.

In addition, Decree 177 after more than 02 years of implementation has basically satisfied the requirements of the price management and administration at the central and local levels according to the market mechanism regulated by the State. basic basis for perfecting the system of legal documents on price management according to its competence, contributing to helping the price management and administration be carried out throughout and uniformly. The management and stabilization of prices have brought about positive effects, basically ensuring the supply and demand of essential commodities, so as to avoid sudden price increases, especially in times when the market has a lot. fluctuations. The pricing work of the State has clearly defined the authority and responsibility to valuate goods and services on the list of those with prices set by the State for ministries, provincial People's Committees. At the same time, the inspection and examination work is strengthened regularly. In addition, other contents on price management and administration such as price negotiation, price database have been implemented quite effectively ...

However, besides the positive results, the implementation of Decree 177 also revealed some inadequacies in the competence and responsibilities of state management agencies at all levels in guiding and organizing the actual implementation. At present, measures to stabilize prices, set prices and declare prices, implementation and coordination among departments and agencies from central to local levels still face many difficulties. Some price stabilization products have many different brands, categories, models, if not clearly specified, the agency responsible for detailing the list of goods items will cause difficulties for state management agencies. competence in examining and supervising production and business organizations and individuals to declare prices while the State does not apply price stabilization measures.

Regarding price declaration, according to current regulations, the time for organizations and individuals to notify price declaration before setting price, adjusting price is at least 05 days, however, in reality there are some items In particular, it is necessary to reduce prices as soon as the cost of inputs decreases, such as freight or regular daily price fluctuations, depending on the evolution of the epidemic, the crop and the market. ... such as gas, agricultural products, fertilizers, pesticides, vaccines, sugar, salt ... Inadequacies arise when organizations and individuals fail to promptly re-declare prices or reduce prices when factors forming volatile prices to reduce damage to consumers. At the same time, a number of goods and services such as exam service, university, college, professional secondary school enrollment; Medical assessment services; Job placement services; Prices of rice varieties, maize varieties, vegetable varieties; Modified Elthanol price (E100); Liquefied natural gas (LNG); Price appraisal service ... has a wide range of influence throughout the country, there is the phenomenon of unfair price competition or unreasonable price increase, adversely affecting social psychology and affecting social security. added to the list of goods and services declared prices for the State to manage ...

Need clearer rules

In order to perform the State management according to the pricing mechanism for goods and services from the list of fees to prices as prescribed in the Law on Charges and Fees, the amended scope of Decree 177 is amended and supplemented this time. Supplementing Article 24 of Law on Fees and Charges.

In addition, the draft decree also provides clearer and more specific authority on detailed guidance of commodity price stabilization as well as a number of complicated technical goods, which divide many categories, requiring ministries. specialized management guides the detailed list to ensure the price stabilization item is suitable for each period; receive and review price registration forms, competence and responsibility to decide on application and organize the application of price stabilization measures to the specialized managing ministries.

The competence and responsibility for pricing of the Ministers are also specified according to the list of goods and services under their management and the list of products and services transferred from fee is added. service prices set by the State. At the same time, supplement the pricing authority of the provincial People's Committee for a number of products and services transferred from fees to service prices set by the State in accordance with the Law on Fees and Charges.

To be more in line with practical requirements, the list of goods and services subject to price declaration, Draft Decree 177 (amended) supplements some goods and services transferred from fee to price including: Services contest, admission to university, college and professional secondary school; Medical assessment services; Job placement services; Prices of rice varieties, maize varieties, vegetable varieties; Modified Elthanol price (E100); liquefied natural gas (LNG); Appraisal service.

For the time limit for price declaration, Draft Decree 177 (amended) provides for goods and services whose prices often fluctuate according to the market or the prices are determined according to specific business conditions. The time to send price declaration documents before setting prices and adjusting prices comply with the Finance Ministry's regulations. In case of declaring a price reduction, organizations and individuals producing and trading in goods and / or services shall immediately reduce prices, and at the same time send notice of the price reduction declaration to competent state agencies.

Regarding the construction and operation of the national database of prices, it is determined that the database of focal prices connecting the price database systems of ministries, branches and localities should propose. Draft Decree 177 (amended) also stipulates the responsibilities of ministries, branches and localities in building and managing the national database on prices in order to improve the legality of the legal documents. to facilitate the development of national databases on prices assigned by the Government.
